CLAIMS
The cause of action on cargo
claims for marine insurance companies is primarily based on Article
2207 of the Civil Code, which states that, "If the plaintiff's
property has been insured, and he has received indemnity from the
insurance company for the injury or loss arising out of the wrong
or breach of contract complained of, the insurance company shall
be subrogated to the rights of the insured against the wrongdoer
or the person who has violated the contract. If the amount paid
by the insurance company does not fully cover the injury or loss,
the aggrieved party shall be entitled to recover the deficiency
from the person causing the loss or injury."

CREW CLAIMS
The employment contracts of Filipino Seafarers
are principally governed by the terms and conditions of the POEA
Standard Employment Contract, which guarantees their minimum rights,
benefits, and compensations. Sometimes, a collective bargaining
agreement is executed between the employers and the Associated Marine
Officers and Seamen's Union of the Philippines (AMOSUP) which provides
for better rights, benefits, and compensations.
Due to the good fortune that
befalls us in handling crew claims, we try to return the favour
by charging the lowest professional fees. Best of all, Seafarers
and their families do not have to pay a single centavo until a successful
recovery. We are mindful that most, if not all, of our clients in
crew claims do not have money to spend on attorney's fees and legal
costs, hence, we make sure that they would not fall prey to unscrupulous
employers who may capitalize on their material weakness while their
cases are pending.
Since we have everything to
gain from big recoveries, and everything to lose in slow recoveries,
rest assured that we shall do our best to have the best and fastest
recovery for you under the circumstances.
